Practical case · People in automated transport
Why should the minibus slow down near a child?
One street, different risks
A manufacturer is preparing a fully automated category M minibus for EU type approval. It is intended to carry passengers along a predefined route with fixed start and end points. An automated driving system (ADS) performs the driving.
In the fictional driving scenario, a child stands near the edge of the pavement, with no barrier separating it from the road. In the same stretch, a wheelchair user is crossing and needs more time. The system detects both people well in advance. A collision is not yet imminent.
A fictional teaching case. The illustration does not specify distances or the capabilities of a particular vehicle.

Rule for your analysis
Regulation (EU) 2022/1426 · paraphrased
How would you expect the minibus to behave around each person, and why?
Use the rule above to think through your answer, then compare it with the analysis and recommendation.

Anticipate risk while approaching
For the child, the possibility of suddenly entering the road matters. For the wheelchair user, the case specifies that crossing takes longer. Slowing down early, maintaining an appropriate distance and, depending on how the situation develops, stopping safely are possible measures. Detecting the people alone does not explain how the system reduced the risk.
Equal value of life, different protective measures
Measures can differ according to the situation and the person's needs. Giving someone more time to cross or slowing down where a person might suddenly enter the road reduces a specific danger. It does not imply that one person's life is valued more highly.
When does the prohibition on weighting personal characteristics matter?
In this case, the system has time to prevent danger. The prohibition cannot therefore be read as requiring the ADS to ignore risks associated with the child's behaviour or the longer time needed to cross the road.
A possible recommendation to the manufacturer
Include situations involving a person potentially entering the road suddenly and situations involving a longer crossing time when designing and validating the ADS. Justify the expected response in each scenario and check whether the system adapted its driving in time.
This is an example recommendation derived from the analysis. The case does not prescribe one correct speed or require stopping whenever a child is present. The response must be justified by distance, speed, visibility, braking capabilities and other circumstances.
Takeaway: protecting every person can require different measures according to the specific risk.
